4UKHost.UK is the trading name of Jomongee Ltd, provides Internet services to many clients, and we have a responsibility to protect each client and to provide the best services available. When you abide by these guidelines, you help ensure that our obligations to you and our other customers are met. All references to 4UKHost.UK is the direct reference to Jomongee Ltd via the trading naming convention.

4UKHost.UK provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of 4UKHost.UK are subject to the following terms of service:

2. Indemnification Policy

You agree to use all 4UKHost.UK services and facilities at your own risk. 4UKHost.UK specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall 4UKHost.UK be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold 4UKHost.UK harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against 4UKHost.UK, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless 4UKHost.UK against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with 4UKHost.UK's server.

4UKHost.UK reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from 4UKHost.UK's server. 4UKHost.UK shall be the sole judge of what violates this Policy.

3. Billing

At this time we bill monthly, quarterly, semi-annually and annually, depending upon the plan. If you are not satisfied within your first 30 days we would be happy to provide you with a full refund (For some special offers the money-back-guaranteed day will be varied; and Domain Name registration fee is nonrefundable).

We accept Visa, Master Card, PayPal, Cheque and BACS. Clients are encouraged to pay by credit card as it is the easiest way to handle payment at this time. There are no contract periods but for each successive period, your contract must be renewed unless we are notified otherwise.

You agree that you are solely liable for arranging that your services are renewed, and that 4UKHost.UK shall not be liable to you or any third party if it is unable to charge your payment method in order to renew your services. You also agree that you are liable for all services that have been rendered on your behalf until a termination of service has been officially received by the accountholder for services.

4. Late Payments

All accounts are billed according to the dates they were first activated on. If you will not pay for service renew in 5 days after deactivation, your account will be suspended. If you will not pay for service renew in 30 days after deactivation, your account will be terminated. You will receive an email reminder 5 days till deactivation.

5. Cancellations

If you wish to cancel your services, you must notify us five (5) business days prior to your renewal date. If your notice of cancellation is not received within this time frame, you will be liable for payment of the preceding month and hereby agree to complete payment as invoiced accordingly.

If you cancel your account and your payments still continue to recur for any reason such as 1) by fault of 4UKHost.UK staff 2) by fault of the credit card processor 3) by fault of any other payment collection company, we are to be held free of liability for any overdraft fees that are issued by your financial institution.

6. Refunds/Account Termination

If, for any reason 4UKHost.UK fails to deliver said services to you, a prorated refund will be issued. No refunds will be issued if abuse of our stated policies forces 4UKHost.UK to suspend or terminate your services prematurely. In the event you request account cancellation, once your service has been cancelled your account will be suspended from use. It will then be deleted within 30 days. Cancellations of accounts pre-paid for on a monthly or yearly basis will not receive a refund for the remainder of the billing period. All add-on service payments are non-refundable as they are included only during the life of the hosting plan. If for any other reason your account becomes suspended and remains suspended it will be deleted after a 30-day period.

4UKHost.UK retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification. You agree to be bound by any changed 4UKHost.UK may reasonably make to this agreement when such changes are made. If you have purchased services or software from 4UKHost.UK, the term of this agreement shall continue in full force and effect as long as you take advantage of and use the software or services that we provide. THIS IS FINAL.

7. Acceptable Use Policy

All services provided by 4UKHost.UK may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United Kingdom and International laws are prohibited United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless 4UKHost.UK and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all 4UKHost.UK servers. This includes sites that include sexually explicit or hardcore images and/or advertising.

Furthermore, 4UKHost.UK believes in freedom of speech; however, any content (written, visual, or implied) in the following areas will not be tolerated and is grounds for immediate suspension of service (in most cases customer will be allowed a zip file of their account): racism or prejudice due to colour, creed, or belief; any violent/malicious/obscene content written, visual or implied. We will not tolerate any type of hate site including terrorist related websites on our network. If we receive notice that there is such a hate site hosted within our network, the customer hosting the material will be notified immediately. They are required to remove the content within a certain timeframe or will face account suspension and/or termination.

Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.

Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

We prefer that you self-govern your content and remain responsible and all-knowing of what your website publically provides. Even if other users have access to your account, you are responsible for their actions. The resources and time needed to govern our servers by checking each website individually, which have growing and evolving content, is impossible. However, if 4UKHost.UK is made aware of any questionable content on a 4UKHost.UK hosted site, we will address the concerns immediately and directly with you to seek an amiable resolution.

Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network.

We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.

Sites using more than 20% of system resources: 4UKHost.UK will be the sole arbiter as to what constitutes a violation of this provision.

Spamming, or the sending of unsolicited e-mail including, without limitation, commercial advertising and informational announcements, from a 4UKHost.UK server or using an e-mail address or domain that is maintained on a 4UKHost.UK machine as reference is STRICTLY prohibited. 4UKHost.UK will be the sole arbiter as to what constitutes a violation of this provision. A user shall not use another site's mail server to relay mail without the express permission of the site. 4UKHost.UK will be the sole arbiter as to what constitutes a violation of these provisions.

Any attempt to undermine, compromise the security of, or otherwise cause harm to any 4UKHost.UK servers or customer accounts is strictly prohibited and will result in the cancellation of the account.

We may allow programs to run continually in the background. These are considered on a case-by-case basis and an extra charge will be incurred based on system resources used and operational maintenance needed.

We reserve the right to refuse, cancel, or suspend service at our sole discretion.

8. LIMITATION OF LIABILITY

4UKHost.UK shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from 4UKHost.UK servers going off-line or being unavailable for any reason whatsoever. Furthermore, 4UKHost.UK shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of 4UKHost.UK servers. All damages shall be limited to the immediate termination of service.

In addition, 4UKHost.UK shall not be liable under any circumstances for any special, consequential, incidental or exemplary damages arising out of or in any way connected with 4UKHost.UK, including but not limited to damages for lost profits, loss of use, lost data, down time, loss of privacy, damages to third party even if 4UKHost.UK has been advised of the possibility of such damages. The foregoing limitation of liability shall apply whether any claims based upon principles of contract, warranty, negligence or other tort, breach of any statutory duty, principles of indemnity or contribution, the failure of any limited or exclusive remedy to achieve its essential purpose or otherwise.

4UKHost.UK will not censor any content on the INTERNET. It will be the CLIENT's responsibility for the usage of his account and any consequences of this usage. 4UKHost.UK makes no endorsement, claims, or promises regarding the services offered by our customers and will not be held liable for any disputes or claims against said customers. In no event shall 4UKHost.UK be liable for any direct, indirect, incidental, consequential, special and exemplary damages, or any damages whatsoever, arising from the use or performance of a customer web site or from any information, services or products provided through a customer web site. If there is questionable content on any server in our network, we will not take any action against any material or action until the website is brought to our attention by contacting our abuse department.

4UKHost.UK makes no endorsement, claims, or promises regarding the services offered by our customers and will not be held liable for any disputes or claims against said customers. In no event shall 4UKHost.UK be liable for any direct, indirect, incidental, consequential, special and exemplary damages, or any damages whatsoever, arising from the use or performance of a customer web site or from any information, services or products provided through a customer web site. If there is questionable content on any server in our network, we will not take any action against any material or action until the website is brought to our attention by contacting our abuse department.

4UKHost.UK will take necessary steps to register domain names on behalf of the client when requested. However, clients are responsible for requesting the renewing their domain names. 4UKHost.UK Domains does not take responsibility for failing to renew domain names. Please note that domain registration is irreversible. If your domain name was registered via our company, you must check and take appropriate actions to renew a domain that is about to expire. We do not handle renewals unless specifically asked for by sending a ticket to our helpdesk. If you have any questions at all about DNS changes or domain names in general, please open a ticket at our helpdesk.

9. DISCLAIMER

4UKHost.UK cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by 4UKHost.UK are resold. Thus, certain equipment, routing, software, and programming used by 4UKHost.UK are not directly owned or written by 4UKHost.UK. Moreover, 4UKHost.UK holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as 4UKHost.UK sees fit. FURTHERMORE, 4UKHost.UK retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.

By registering your domain with 4UKHost.UK you agree to the Registrant Rights & Responsibilities as outlined by Nominet and ICANN.
